Agartala: Jan 31: CPM State Secretary Jitendra Chowdhury had sent a letter to the Returning Officer demanding cancellation of the nomination of Mobswar Ali, a long-time communist friend and now BJP candidate for the Kailashahar constituency. According to him, Mobswar Ali did not resign from the membership of the Vidhan Sabha and the civic post of the CPM. Therefore, according to the Election Commission Act, his nomination should be cancelled. But, no one objected against him during the nomination paper examination. Therefore, the returning officer has sealed Mobswar Ali’s nomination as a BJP candidate as valid, said Pradip Sarkar, the district governor of Kailashahar.
In a letter written to the Kailashahar Returning Officer today, the CPM State Secretary said that in 2018, Mobswar Ali was elected as a CPM candidate in the Kailashahar Centre. In this case, he cannot accept the membership of any other political party or be an independent candidate without resigning as a member of the Legislative Assembly or being expelled from the party. However, despite being a CPM MLA, he mentioned himself as a member of the BJP party while filing nominations.
According to his claim, Mobswar Ali cannot submit nomination as a BJP candidate as per the Election Commission’s law regarding the use of party symbols because; he did not resign from the post of member of the assembly and did not leave the civil post of CPM. Therefore, necessary legal action should be taken to cancel his nomination, demanded CPM State Secretary Jitendra Chowdhury. In this regard, Kailasahar Returning Officer and Sub-Divisional Magistrate Pradip Sarkar said that no one has objected to BJP candidate Mobswar Ali since appearing during the examination of nomination papers today. Hence, there is no legal action against him. He said that the nomination paper of BJP candidate Mobswar Ali has been considered valid.
